Commercial arbitration is well-suited to disputes arising from construction contracts, joint venture agreements, trade transactions, shareholder disagreements, and cross-border commercial arrangements. If the underlying contract contains an arbitration clause — or if the parties mutually agree to arbitrate — Sablecroft can assist throughout the proceedings.

Mediation is a facilitated negotiation where a neutral mediator assists both parties in reaching a voluntary settlement. The mediator does not decide the outcome. Arbitration, on the other hand, results in a binding award issued by the arbitral tribunal. Mediation often preserves relationships and resolves matters more economically; arbitration provides a determined outcome when agreement cannot be reached.

Yes. Malaysia is a signatory to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Foreign awards from Convention member states may be recognised and enforced through the Malaysian High Court under the Arbitration Act 2005. Sablecroft handles the full application process, including responding to any setting-aside challenges raised by the opposing party.

The duration depends on the complexity of the dispute, the number of parties involved, and the applicable rules. Straightforward matters may conclude within six to twelve months. More complex commercial disputes — particularly those involving multiple witnesses or technical experts — may take 18 to 36 months. We will give you a realistic assessment during the initial consultation.

Our services are engagement-based and structured around the nature of each matter. Mediation & Conciliation engagements begin from RM 2,500; Arbitration Award Enforcement from RM 4,800; and Commercial Arbitration from RM 6,500. Fees are discussed transparently at the outset. Complex matters with extended hearing periods are scoped separately.
